Please read these Terms of Service carefully before using Docka. By accessing or using our Service, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using the Docka platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Docka is a multi-cloud DevOps platform that enables users to:

  • Provision and manage servers across multiple cloud providers (AWS, Google Cloud, Azure, Hetzner, DigitalOcean, Vultr, Linode, OVH, and others)
  • Connect and manage your own servers (BYOS - Bring Your Own Server) via our agent
  • Deploy applications from Git repositories using Docker, Nixpacks, or Buildpacks
  • Provision and manage databases (PostgreSQL, MySQL, MariaDB, MongoDB, Redis)
  • Manage object storage (S3, GCS, R2, MinIO)
  • Configure custom domains with automatic SSL certificates
  • Set up CI/CD pipelines and automated deployments
  • Monitor infrastructure with real-time metrics and alerts
  • Access servers via web-based SSH terminal

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain the security of your password and account credentials
  • Promptly update your account information if it changes
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access or security breach

4. Cloud Provider Credentials

To manage resources on third-party cloud providers, you must provide API credentials. You acknowledge that:

  • All credentials are encrypted at rest using AES-256 encryption
  • Docka uses these credentials solely to perform actions you request
  • You are responsible for ensuring your credentials have appropriate permissions
  • You should follow the principle of least privilege when creating API keys
  • Docka is not liable for actions taken with valid credentials you provided

5. Bring Your Own Server (BYOS)

When connecting your own servers to Docka:

  • You grant Docka permission to install and run our agent software on your servers
  • The agent collects system metrics and enables remote management via WebSocket
  • SSH credentials provided are encrypted and used only for agent installation
  • You retain full ownership and responsibility for your server infrastructure
  • You are responsible for maintaining server security and updates

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Deploy malicious software, viruses, or engage in cyberattacks
  • Conduct cryptocurrency mining without explicit authorization from the server owner
  • Distribute illegal, harmful, or objectionable content
  • Send spam or unsolicited communications
  • Interfere with or disrupt the Service or other users
  • Attempt to gain unauthorized access to any systems or networks
  • Resell or redistribute the Service without authorization
  • Use the Service to compete with Docka

7. Third-Party Cloud Provider Costs

Important Notice

You are solely responsible for all costs incurred with third-party cloud providers. This includes but is not limited to:

  • Compute instances (VMs, containers)
  • Storage (block, object, database)
  • Network bandwidth and data transfer
  • Managed database services
  • Any other resources provisioned through Docka

Docka does not control or guarantee cloud provider pricing. We recommend setting up billing alerts with your cloud providers and regularly monitoring your usage. Docka provides cost estimation tools, but these are estimates only and may not reflect actual charges.

8. Service Fees and Billing

Docka may charge fees for certain features or usage tiers. If applicable:

  • Fees are billed monthly in arrears or as otherwise specified
  • All fees are non-refundable unless otherwise stated
  • We may change pricing with 30 days notice
  • Failure to pay may result in service suspension

9. Data and Security

We implement industry-standard security measures including:

  • AES-256 encryption for all stored credentials
  • TLS 1.3 for all data in transit
  • Regular security audits and penetration testing
  • Role-based access control
  • Audit logging for all administrative actions

However, no system is completely secure. You acknowledge that you use the Service at your own risk. We strongly recommend enabling two-factor authentication and regularly rotating API keys.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted service. You acknowledge that:

  • Scheduled maintenance will be announced at least 24 hours in advance when possible
  • Emergency maintenance may occur without notice
  • Third-party cloud provider outages may affect the Service
  • Network issues beyond our control may cause disruptions

11. Intellectual Property

The Service, including all software, designs, and documentation, is owned by Docka and protected by intellectual property laws. You retain ownership of your data, applications, and configurations. You grant Docka a limited license to use your content solely to provide the Service.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCKA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Business interruption or downtime costs
  • Cloud provider charges incurred due to Service use or outages
  • Security breaches resulting from user negligence
  • Third-party claims arising from your use of the Service

Our total liability shall not exceed the amount you paid to Docka in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold Docka harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Termination

Either party may terminate this agreement at any time:

  • You may delete your account at any time through the settings page
  • We may suspend or terminate accounts that violate these Terms
  • We may discontinue the Service with 30 days notice

Upon termination, your access to the Service will cease immediately. You remain responsible for any outstanding cloud provider charges. We recommend exporting your data before account deletion. Data will be deleted within 30 days of account termination.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the modified Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
